We Are Not Presumed Sane

Which brings us to an interesting point of law: (tap) Clearly the Constitution guarantees that 'the accused is to be presumed innocent until proven guilty.' We all know that. The accused is to be presumed innocent. Only conviction can guarantee guilt (and even a conviction is not an absolute guarantee).

But there seems to be no such corollary rule regarding sanity. We are not presumed sane! At least not in Arapahoe County Colorado. At least not at the ACSD. Gullible Goodman apparently concluded, after hearing Gerash's fig leaf defense, that I was 'insane' and felt no further need to investigate.

Was Goodman being paid by Gerash? I think so. I think that Goodman was (and remains) corrupt. Is Goodman a Jew? Is it Tribal as well as monetary? May well be, I don't know.

In any case I think we need to change that un-American attitude. The police should presume a person sane until proven otherwise in a court of law. That is to say that only a judge can declare a person insane based on sufficient psychiatric testimony. Police 'intelligence' (something of an oxymoron) should have no place in the determination of any person's eligibility for police service.

So we went to the 'marriage counselor.' I explained our problem to him in detail. Kootch then gave him her side of the story in the most incomprehensible mish-mash of the English language I have ever heard her articulate. He seemed very interested. Indeed he seemed to agree with her bizarre unintelligible (even to me!) version completely. At the end of the meeting he made no attempt at all to resolve our problem, but only said, 'Gerash would never do something like that.' End of interview. Huh?! He knew Gerash?!

Was that guy's name, 'Clark?' Could well be. I don't remember.

My interpretation is that here was a 'purchased diagnosis' paid for by Gerash. It was a setup from the beginning designed for me to 'acquire a diagnosis' which could later be used by Gerash as a 'fig leaf' (tap). And Gerash himself (according to Gullible Goodman) used the term, 'obsessed.' Did Clark issue me a 'diagnosis' of 'obsessed?' If so, it would be a projection of Gerash's mental illness onto me.

And is a diagnosis sort of like a ticket? Apparently not. When a cop issues you a ticket you either pay up or go to court and fight it or become a fugitive from justice. A diagnosis is not like a ticket. You can't fight it. It sort of just hangs around you. Once you have been 'diagnosed' you can be characterized by others as a person who 'has a history of mental illness.' Mention that 'diagnosis' (tap) to the police and the spotlight immediately shifts away from you and onto your accuser. A 'diagnosis' is a very effective defense (tap) against police investigation.

As to the interpretation of the document in question I suppose there are several possibilities, some more likely than others. I think my interpretation is the most likely. Here it is:

Gerash was alerted by Goodman's initial call and soon discovered (either through Goodman directly or through another ACSD(?) source) that I had filed an official complaint against Gerash. Gerash then fabricated a plausible scenerio which would 'explain' (faint boom) my charges to the gullible detective Goodman. Gullible Goodman apparently accepted the 'explanation' and no further 'progress' was made in the case.

Goodman asked me about 'Doctor Clark' ('Do you know a Dr. Clark?) in a later interview and I replied in the negative. The name rang no bell with me. Only after I read the Goodman report did it dawn on me that Goodman might have been referring to a meeting Kootch (tap) and I had had with a 'marriage counselor' in the early '90s. Kootch had suggested (and arranged for) the meeting after we had had numerous arguments around my failure to communicate to her the fact that I was being 'stalked' (although I had yet to discover that word or that concept). It seemed to me at the time that what we had here was a failure to communicate. Kootch, for example, could not comprehend my claims that for several years in the late '80s - early '90s our cars (locked cars!) had been entered by someone who followed me around occasionally and entered the locked car and rotated the mirror clockwise to the stops.

Regarding Detective Goodman's 'report' I should say that I came across it quite accidentally, it being part of 'discovery information' (tap) given to me by the ACDA (District Attorney) in relation to a criminal case pending against me. That may have been in about '98 or so. The DA later dropped the charges in that case for 'lack of evidence,' when their prime witness, a fella name of Ocana, disappeared along with another witness. They both lived upstairs and moved out soon after I pleaded 'not guilty.' (BTW: It always happens: soon as I plead 'not guilty' they move out and are never heard from again (tap). The criminal charge against me came after I got drunk one night and flipped off the circuit breaker to 304 (above). They called the cops. The cops charged me.)

I was quite gratified to receive this information from the DA because it tended to confirm my subjective impressions of detective Goodman. It also provided me with insight into exactly how Gerash operates. I'm sure it was an oversight by the Gerash 'team' that allowed the document to fall into my hands. Surely they could have had a 'mole' in the DA's office (tap) 'screen' the discovery documentation before it was presented to me. Obviously 'they' fucked up.

That he has no idea of who this patient of DR. CLARK's may be.

That it might be advisable for this investigator to speak with DR. CLARK.

That he hopes this individual is not violent in nature.

I have been 'dragging my feet' in this matter because it is so depressing to think about it. My previous experience with the ACSD has been consistently negative (boom). Indeed, the ACSD has seemed to be on the stalker's side over the years. It is as if Gerash owns the ACSD. But this is certainly an illusion. Right?

And I must also admit to stooping to the level of 'demonstration of power.' I am not just another faceless yahoo. I am a blogger. I have power. And that power includes the power to ridicule the ACSD. I have The Will to Power and I will use it if necessary. Reluctantly, of course.

Getting back to the document in question:

It is a typed document, a 'progress report,' and apparently the only such report concerning case number CR 95-419. Here is the gist of it:

01-10-95 Goodman calls Gerash. No contact.
01-11-95 Goodman receives a VMM (voice mail message) from Gerash. Goodman calls again. No contact.
01-17-95 Goodman calls yet again. Gerash later that day returns the call. Goodman advises Gerash that 'an individual' had reported to the ACSD that he was being harrassed by persons (tap) who were operating under the direction of Walter Gerash. Mr. Gerash stated he had no idea what this person was talking about, however, after reflection for a short time stated the following:

'This is a test...

'Test failed. The test involved uploading a scanned document to Blogger. The first few times I tried to upload the scanned document I got the standard 'site not found' error (The page cannot be displayed). Later, however I was able to upload another test scan to Blogger, but when I tried again to upload the document in question I repeatedly got the 'There were errors during upload' message from Blogger. I'll try again later. If it turns out that I am not able to upload the document due to 'technical problems' I will simply type the document into Blogger. My current theory regarding my lack of success in this regard is that 'they' have managed (tap) to corrupt the link to Blogger such that the upload failed repeatedly.'

Most of that was written yesterday when I was still in 'business mode' (or as I once characterized it, Economic Mode). The idea was to lay a further foundation for contacting the ACSD beginning at the 'top.' I figured that if the ACSD did indeed respond to my request for Police Service in this matter they would begin by reading the most recent post. I wanted to hit them right at the beginning with an example of previous ACSD 'incompetence.' (I use the word, 'incompetence' in favor of other, less inflamatory words like - for example - 'corruption.')

But today is another day and I am in Fun Mode. I will get back to Economic Mode next week. I will then (thump) try again to upload the document, which is an ACSD document titled:
